Emunand is emunand at this point, regardless of if you used a program like Emunand9 or GW to make it, and no it does not matter. You can't select it because you are downloading a specific title by TitleID.

but I get a message that I need to accept the latest version of the nintendo service user agreement and privacy policy, only option is to return to home menu.

I would highly recommend updating emunand to 9.5.0-23X before you attempt to do this, if for now other reason than because I cannot insure via personal experience that it works properly on anything else as a starting point.

10.3.0-28X is the highest firmware so if you have an O3DS and its emunand is fully updated you can access all online features with no funny workarounds.

install sysupdater (I would suggest 0.4.1 as its the latest "official" release, the 0.4.2 should only be used for downgrading atm imo), then grab a N3DS 9.5.0-23 update cia package for your region from that iso site.
Put the cias in the updates folder and boot up emunand, then use sysupdater to update it.
The warnings about not using sysupdater to update with GW or rxMode only apply to sysnand. You can safely use it to update emunand without worry.
If you want to be extra safe/careful, back up the emunand first.

Are your nands unlinked? If so did you accomplish it by doing a system format from system settings inside emunand?
If yes to both then it sounds like thats the problem.

Well I buggered my emuNAND somehow. It comes up with "Opening Home menu, do not turn off the power..." and then that disappears after a few seconds, leaving a black screen. I installed the CIA for sysUpdater and ran it fine but I looked away for a minute and then my 3DS just autorebooted. I can still get to HBL fine.
The auto-rebooting seems weird. Do you have a backup of the emunand you can inject?

Also, you can do a sysNAND backup (if you didn't unlink them yet) and restore to emuNAND (I used Decrypt9)Nope. Should've backed it up. Dammit. Is there any way I can get sysUpdater to run on the emuNAND again with only access to HBL? Maybe I can stick 9.2 in there again and have it work.
