It's probably permanent. You should wait for the dust to settle, and then you can try an unban method.
If history is any indication, your NNID and Switch will likely be unaffected. For example, NNID bans on the 3DS during the Pokemon Sun/Moon incident didn't actually ban the NNID, and they didn't affect those same NNID accounts on the Wii U. This also doesn't appear to be an NNID ban of any kind this time.
Yes, the title ID is sent over the Nintendo Network and parsed by the receiving console. It will show up as "unable to retrieve software title" otherwise. I believe this is probably the biggest flag that determines whether or not a user is using CFW.But if only the one who sets it as favorite has it, it'll be a question mark or something like that. So the 3DS does something like: get titleid from server -> if it has it installed, it shows the icon, else it gets the icon for the title from the servers. This means that the title id is actually sent to the servers.
What if the ban is triggered by Spotpass but only if you played Spotpass games like Fire Emblem, Monster Hunter (I think it has Spotpass), Mario Kart 7, SMB or such?
Because, in my case, I always disable Spotpass (it annoys me) in games when they ask. However, I had Spotpass download on.

Any VC nes,snes,gb/gbc have option to send gameplay information i bet a lot of people didint knew or checked and pressed A button ...lol to those who sent final fantasy III snes gameplay info to nintendo anyway i think it should be added to poll since it is a option for sharing info to nintendo.

This is just speculation. It depends on what data they are sampling, what time periods they are sampling from, what factors raise flags, and how those factors weigh.If they did cultivate all this data until now, it would mean that even unbanning yourself with another consoles LFCS would be pointless as your console ID would be flagged as CFW already no?
Or do they need constant telemetry feedback to determine if someone would have to be banned or not?
