1. It's pretty much confirmed to be a permanent ban. Someone called Nintendo, and got told it's perma.
2. No, it's not an NNID ban, so your Wii U and / or Switch should be fine.

It's probably permanent. You should wait for the dust to settle, and then you can try an unban method.

If history is any indication, your NNID and Switch will likely be unaffected. For example, NNID bans on the 3DS during the Pokemon Sun/Moon incident didn't actually ban the NNID, and they didn't affect those same NNID accounts on the Wii U. This also doesn't appear to be an NNID ban of any kind this time.

Okay. Thanks. If only I had turned those setting off before. Now I just turned off Wireless communication, sending system data over spotpass, and sharing played title to friends.

But if only the one who sets it as favorite has it, it'll be a question mark or something like that. So the 3DS does something like: get titleid from server -> if it has it installed, it shows the icon, else it gets the icon for the title from the servers. This means that the title id is actually sent to the servers.
Yes, the title ID is sent over the Nintendo Network and parsed by the receiving console. It will show up as "unable to retrieve software title" otherwise. I believe this is probably the biggest flag that determines whether or not a user is using CFW.

What if the ban is triggered by Spotpass but only if you played Spotpass games like Fire Emblem, Monster Hunter (I think it has Spotpass), Mario Kart 7, SMB or such?

Because, in my case, I always disable Spotpass (it annoys me) in games when they ask. However, I had Spotpass download on.

I'm in the EU and maybe the ban wave hasn't come but it could be.

all i play is smash bros i hope that's not a spotpass game but it probably is

Eh I'm not sure if this is related, but what kind of error is this? "an error has occurred forcing the software to close" I only get this trying to play Pokemon Sun/Moon via New 3DS but works fine on Old3DS
under Boot9Strap btw

My question is what the "hide titles" setting in the friends list does. Does it hide them from your friends, or does it also block them from being sent to Nintendo's servers at all?
While I think it's probably too late for a lot of users (data has probably been collected for a while now to populate the "CFW user model"), I think sniffing the data that is transmitted would be worthwhile.

If they did cultivate all this data until now, it would mean that even unbanning yourself with another consoles LFCS would be pointless as your console ID would be flagged as CFW already no?
Or do they need constant telemetry feedback to determine if someone would have to be banned or not?

I bet Custom VC games are a good way to find out if you are not legit !

Any VC nes,snes,gb/gbc have option to send gameplay information i bet a lot of people didint knew or checked and pressed A button ...lol to those who sent final fantasy III snes gameplay info to nintendo anyway i think it should be added to poll since it is a option for sharing info to nintendo.

Checked this morning and I'm still not banned. I had these options turned on, but turned them off last night. Guess I'll know in the near future if I've been banned or not. Since I've had those options enabled in the past I really don't want to place my vote yet either.

This is just speculation. It depends on what data they are sampling, what time periods they are sampling from, what factors raise flags, and how those factors weigh.
