I can see the value in collecting title ID data without the end-user knowing.

This is just speculation. It depends on what data they are sampling, what time periods they are sampling from, what factors raise flags, and how those factors weigh.
It might also be that when coding everything, it was just easier to have the only variable be the "privacy flag," which is why I had my doubts in the first place.

Had both of the Spotpass options with 'On'. Banned.

Going a little off-topic, but i've been trying to get the LocalFriendCodeSeed_B from my Old 3ds (10.3.0.28E, i believe. No CFW. Had nothing of Homebrew until now), however, no matter if i use Decrypt9 or Godmode9, i just get a red screen, and then it kicks me back to the HL.
I've tried multiple version of Decrypt9, but no luck. Any help?

I also tried the LocalFriendCode thing and I took one from that chaos site
But nothing happened, still banned :/
because that one is banned aswell...

You have to have ARM9 access to use those. So either use safehax or downgrade it to 9.2.

Oh, i see. Thanks. That would explain why i could use it in my New 3DS Sysnand xD (That one it's in 9.2)

I haven't been near any recently, but I though all of those were shut down a long time ago. Are they still a thing? Also I doubt this has anything to do with this at all, as lots of people are being banned, and I think it would be impossible for all of them to have been to a Nintendo Zone.

Well at least in my city there are a few but now that I remember that I hacked 2 3DS last week for a friend i'm afraid she's going to get banned and mad at me at the same time :v

Be any chance did you check if you activated share gameplay info of one those cudtom VC at least 1 time? Maybe be accident or you never checked that? When you start a new VC it ask if you want to share info just asking .
Never did that, I'm extra sure
