Nintendo takes down the Breath of the Wild randomizer mod from Gamebanana

Another day, another Nintendo DMCA takedown against fan-made content.

Just a few minutes ago, Nintendo issued a DMCA takedown notice against a widely known and popular Randomizer mod for Breath of the Wild made by Waikuter and hosted in Gamebanana. Effective immediately, the mod in question has been completely removed from Gamebanana with the quote "This Mod has been trashed for a rule violation", with the rule violation in question being listed as "DMCA Takedown".

It's important to note that, as it has been the case with other recent takedowns seen from Nintendo, this was issued from the domain "mm-nintendo.com", which is a MarkMonitor operator for Nintendo themselves to issue these kind of take downs and notices.

It seems that Nintendo has started to handle takedowns in what looks to be an automated/bot process through MarkMonitor, as several other places with mods and Nintendo assets, like imagery and its characters, have been receiving the same notices from that mm-nintendo.com domain, like in the case of Gmod and its takedown of 20 years-long Nintendo assets, and it's worth mentioning that romsites have also been receiving these particular notices as of late from the same domain.

Of course they did. Nintendo hates fans who take the game they (most likely) purchased, and have more fun with it, and maybe make livestreams/videos about it, WHICH IS FREE ADVERTISEMENT!!! I hate Nintendo as a company so much.

Thanks for the write up. Although, I have a few more questions.

How did Nintendo rob Rare blind?

Also, I looked up Argonaut Software's founder, Jez San, and it seems he's still alive. I know the company shut down in 2007, but I don't know how any of the legalities in regards to Star Fox 2 work.

nintendo doesnt want any customers to have fun with there product. they just want ur money and will treat u like a slave if u pay them. u must say yes master i wont touch that game any way but the slave way.

TotK is the very latest Zelda game. And you need a modded switch or emulator and rom to play it yeah? The scene is stepping on Nintendo's toes, flaunting these mods and stuff on ordinary websites.

I'm intrigued. What did Miyamoto do to Argonaut and Rare? I know Starfox 64 was handled internally by Nintendo instead of Argonaut, not to mention pulling the plug on Starfox 2 late in development. For Rare, I know they went over to Microsoft to make glorified mini-games and character avatars.
With Rare, I suspect that Conker's Bad Fur Day didn't jive with Nintendo's image, so the asking price for the other 51% of the company must have seemed too high. I'm glad the Rare founders got their payday anyway, they earned it.

I bet this was so prejudicial to ninty, if I'm ever posting a mod for a Nintendo game (I did a few for my usage) I'm mirroring it in the tor network, i2p, torrent and every single mod website.
As should be done for every mod. I think the entire DMCA should be repealed, but that's a much bigger issue. The least we can do when making, or even just playing other's mods, is to mirror them everywhere.

At least Nintendo's lawyers mostly stick to pursuing action on websites with "one click takedown" buttons, although even then they're weirdly picky (just one botw mod when gamebanana has several thousand?)

I think the Gamebanana team peed themselves and rushed to deleted the mod without even considering if the threat was legit or not.

Okay, they took down the BotW randomiser.
Can they please take down BotW itself next, and return to classic Zelda? Ocarina of Time, the first 3D Zelda, still is far more enjoyable than this (but go play OoT3D instead, these days; it looks better and plays better).
