I wish people wouldn't make videos like that. Announcing homebrew, hacks, and other fan stuff is a good way to get it shut down.

The main difference is that this doesn't use any trademarked or (to the best of what I see) copyrighted-by-Nintendo stuff, unlike romhacks by their very definition

Quite possibly only temporarily, though, because Nintendo could implement more extreme measures to ban a console. For example, they could take the unique ID of a piece of hardware (if readable, unique HWIDs do indeed exist within the 3DS) and use that to ban a console. Even a MAC address would suffice, but I'm sure someone would figure out how to spoof that, and it would work because Nintendo's opsec is garbage. Though to be honest, I feel their interest for the 3DS is dwindling, and thus so is their interest in banning people.
Thought I'd reply to this, I don't really have any intrest in banning anyone but (some) HW info will be logged upon registering a NNID using my service and hopefully nobody complains that I'm logging too much. osu! is the one that logs too much by legit logging your HWIDs and taking screenshots of your desktop, nobody complains about that apparently (even tho there are like 10 million users on it).

This project seems overambitious, as well not being focused on a true goal (the name really doesn't matter, "Project TK" or anything else works for now). With that being said, I wish you and everyone working privately the very best of luck and success (although I would forget cloning the eShop right now, as hosting any of Nintendo's copyrighted works is asking for a C&D). Projects like Wiimmfi, Kaeru, RiiConnect (amazing name right there :P) and others are proof that there is a desire for these services to continue in as seamless of a fashion as possible, but just know that there is a lot of reverse engineering involved. If you aren't already, start capturing and isolating packets when you trigger specific events (and if possible get people from different regions involved as well); basically any time *.nintendo.net or *.nintendowifi.net is contacted, you'll want to know why, how and for what.

As far as system resources, a free Heroku/AWS/etc alternative instance should be plenty to get started, as the most important part of the service at this stage is to have a public and accessible IP/ports. If this turns into something solid, the community looks out for its own ;)
