Piracy is a crime sure, it's not more of a crime on GBATemp. The forums just have a policy against helping people pirate on these forums. The policy is mostly to avoid potential legal problems.
You know what should be criminal, consoles and console exclusives. I'm not going to spend $350+ of my hard earned dollars to play one game just because Nintendo/Sony are greedy aholes.

Not wanting to spend $350 on a single game makes tons of sense to most people. Maybe you just love throwing money away. Super mario odyessy is the only game I want to play from the switch. Obviously my desire is not so much that I'm going to go out and waste a bunch of cash. I can wait.
