How would they do that when the DNS redirects to smea's server first? They can point the youtube app to nintendo server that use some kind of encription/varification with the app and then redirect to youtube.com (Which will make the app more slower and unusable). And the can always remove the app and embeded it in to the spider web browser

Nintendo has all its right to prevent you or anyone from running homebrew software on its hardware.
