Homebrew Why hasn't Nintendo STILL removed Youtube from eShop?

I don't know if Swapnote was an advertised feature of the 3DS. Meanwhile, Nintendo TVii was more likely to be one, yet it was pulled with seemingly no issue.
Swapnote got added long before the YouTube app and became a preinstalled app afterwards, if memory serves Nintendo did advertise swapnote as a 3DS feature after it's release too. I don't ever recall buying a 3DS with YT preinstalled and I've owned every model except the N3DS XL (I have the regular N3DS)

Nintendo notified of TVii's removal in advance (and many regions couldn't even use the app in the first place, it just gave an app not available in your region message)

Did they actually say anything about sending notes to friends online with SpotPass? Swapnote still functions in StreetPass, despite how much emphasis was probably put onto the online functionality.

because google will try to sue nintendo
I'm sorry but this doesn't seem likely. Google does not own Nintendo, develop the 3DS system software, or create the 3DS hardware. Nintendo has all its right to prevent you or anyone from running homebrew software on its hardware. Besides, this can possibly seen as a security hole, so why should Nintendo not try to secure its own system, or Google force Nintendo to keep one open?
