Anyone can now sign up for the Nintendo Developer Portal

I encourage anyone who does not intend to release anything on the eShop to avoid signing into the portal or the NDI (Nintendo Developer Interface) from now on.

From the notice about Nintendo's recently updated terms:
Note that any developer who uses this service after the date of the changes will be considered to have agreed to these changes.
In other words, signing in to the portal or the NDI will automatically update the terms that you are bound to.

Here is why signing in is a very bad idea if you do have no interest in releasing anything on the eShop:
This Section 8 imposes no obligation upon you with respect to Nintendo Confidential Information that (ii) is or becomes publicly available through no fault of you authorized release or disclosure by Nintendo
This new wording removes a legal loophole that I discussed in another thread a while back.

By signing in, you and any SDK projects that you release will no longer be protected from successful legal action by the older exemption rules. Worse yet, it could potentially lead to legal problems for emulator development and for homebrew made with open source SDKs. This is due to their development relying on information found via reverse engineering, rather than information made available via "authorized release or disclosure by Nintendo."

The only situation where you would likely be safe logging in is if you made an account using fake information and a VPN and/or Tor, and you made sure to avoid logging in without hiding your real IP address. As long as you continue logging in only while using a VPN and/or Tor, then you should be safe, and Nintendo will probably never be able to track you down.

This is the end of the important notice. Everything that follows is from my original post.

On July 6, 2016, Nintendo merged the Wii U Developers Program and the Nintendo Developers portals.

Not only do Wii U Developers program members get access to 3DS development software, but the entry requirements have been lowered big time.

You can now sign up, agree to the NDA, and access the full portal, even without being a Wii U Developers Program member!

What does this mean for you?

Go to, register, agree to the NDA, and enjoy easy and fully authorized access to all of the SDK tools!

If you are a homebrew developer, you can also start preparing your projects for official eShop releases!

Keep in mind, however, that Nintendo will not allow you to publish your project(s) to the eShop unless you buy a development console for the platform(s) that you have made your project(s) for.

Of course, if publishing projects(s) for the eShop does not interest you, and/or you do not have the money for a development console, that does not stop you from allowing other people who have signed the NDA from enjoying your project(s) with 3DS CFW (after converting them from a dev build to a retail one) or Loadiine! The other great thing about this is that you do not have to follow the restrictions that Lotcheck enforces!

Examples of the benefits of creating project(s) that are not being developed for the eShop include:

  • ARM11 kernel access for your CTR-SDK project(s)!
  • Being able to port and further develop fanmade Unity projects with Nintendo or another company's IP! One example is taking the Super Mario 64 HD project source code and using it to develop Super Mario 64 U. (Touchscreen map on the GamePad like in the DS version anyone?:D) Just make sure to watch out for this imposter of a former Nintendo employee. He claims to be part of Nintendo's legal team so that he can get away with removing links to fanmade content!
Now with that said...

Try it for yourself right now!

Whether or not this is just a temporary error in Nintendo's system is yet to be determined, but it seems rather unlikely at this point.

Here are some tips for users who are having trouble with setting up an account:

  • Putting a check on the box for "This organization has an existing publishing agreement with Nintendo." can sometimes lead to you receiving the confirmation emails faster.
  • Make sure that you check for two emails; one with a link for confirming the registration, and another with a link to the NDA.
  • If you are having trouble logging in after this, then follow these steps for creating a new password to replace the randomly generated one that Nintendo gave you.
    • Go to
    • Select the My Information tab on the left.
    • Select the Edit User tab below the black navigation bar on the top.
    • Type a new password into each of the New Password form boxes.
    • You should now be able to log in successfully!

If you are considering joining, here is the agreement that you will have to accept:
Terms of Service and Non-Disclosure Agreement

Last Updated: July 9, 2015
The following Terms of Service and Non-Disclosure Agreement (the "Agreement") constitute a legally binding agreement between Nintendo Co., Ltd. You may not accept this Agreement if you are a person barred from receiving the Services under applicable law, including without limitation, the laws of the country in which you reside or in which you use the Services. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT CLICK THE “I ACCEPT” BUTTON OR UTILIZE THE PORTAL OR THE SERVICES.

By entering this Agreement on your own behalf you represent and warrant to us that you are the age of legal majority in your country of residence.

Entities. If you accept this Agreement on behalf of a legal entity (e.g., a corporation, limited liability company, etc.), you represent and warrant to us that you have the authority to bind the entity to this Agreement.

Nintendo Affiliates. This Agreement is between you and Nintendo. However, Nintendo may delegate certain of its obligations under this Agreement to, and the Services may be provided by, Nintendo’s affiliated entities (including Nintendo of America Inc. and Nintendo of Europe GmbH). Nintendo shall remain liable under this Agreement for Services performed by its affiliated entities.

The Services contain Nintendo owned or licensed content, including, without limitation, logos, designs, text, graphics, pictures, information, data, software, sound files, and other materials (collectively, the "Materials"). The Materials are the property of Nintendo or its licensors and all Materials are protected under applicable intellectual property laws.

Subject to your compliance with this Agreement, we hereby grant you a limited, royalty-free, non-assignable, and non-exclusive license to use the Services solely in connection with the development of applications or other content designed for use on our platforms, together with any other purpose expressly authorized by us in writing. You may not use the Services for any other purpose. Software provided as part of the Services is licensed and not sold to you. Nothing in this Agreement gives you a right to use any of our trade names, trademarks, service marks, logos, domain names, or other distinctive brand features. We reserve all other rights not expressly granted in this Agreement.

You are responsible for all activities that occur under your account. Except to the extent caused by our breach of this Agreement, we and our affiliates are not responsible for any unauthorized access to your account. You agree to contact us immediately if you believe an unauthorized third party may be using your account or if your account information is lost or stolen.

You acknowledge and agree that: (i) only those employees and contractors that you designate as Administrators and Users will be provided access to the Services, and (ii) you are responsible for all acts and omissions of all Administrators and Users in connection with the Services, including without limitation, any breach of this Agreement. You will ensure that Administrators are responsible for the following items in connection with the use and maintenance of your account:

Submissions by any Administrator or User will be deemed to be made with the authorization of their entity.

Monitoring the Forums. To the maximum extent permitted by applicable law, we may monitor any electronic communications you make in connection with the Forums (except private communication) and may disclose such information in the event we have a good faith reason to believe that disclosure is necessary for purposes of ensuring your compliance with this Agreement, or for protecting the rights, property, or interests of Nintendo or any third party. Seems like a rather large oversight. It'll certainly be convenient for everyone until they fix it though

Eh. Ryan can't speak for a company like Nintendo. We aren't too sure if it's a bug or not. If it is, be aware that it will be fixed promptly.
