Emunand is saved entirely to the SD card now. They could still detect it if you went online with it. Or if they scanned your SD card while in OFW. I doubt they would ban for that though.

I read somewhere, that the save games are still saved to NAND and thus Nintendo would be able to detect any NSP game that way

Yes, the savedata is still on the Nand, the emulated Nand on SD.

This is good they released an update to 6.2 and not wait til their 3.0 was finished. They should have done this along the way instead of holding out

I just wish Atmo would put emunand in. Or use SX OS EmuNAND or somit.. it’s the only reason I use Sx
