It's too early to know what will be safe or not. Also, all the warnings about how it's different this time round and getting banned will be super likely have all come from the people that profess to be against piracy. So, how much of that is biased scaremongering and how much is good information?

The only thing you have to decide is whether you care about online gaming and eshop. I hate digital downloads and don't think of Nintendo consoles as online gaming machines really.. so easy decision for me.

This isn't about buying the game or not. Simply a discussion of loading backups.

I assume that if you're banned, you can't receive game updates for games anymore either? (I know you lose eshop access, but I don't know if game updates still go through).

Just my personal opinion, it doesn't have to apply to anyone else. All my multiplayer gaming is usually done with kids in the same room.

Please provide the code evidence rather than your feminine intuition or crystal ball. Also, if telemetry is good enough then anyone who has run hekate so far could get a ban eventually even if they are playing bought games at the time.

private header generator like 3DS

There's no such thing as a "private header generator" for 3DS. You needed to have a legit private header from a cartridge, and then inject it in your other games. We were lucky that Nintendo didn't seem to check which headers belonged to which game. If they learned their lesson, this won't be an option with the Switch and playing online with a pirated game without being banned.

At least in the few bans we've seen so far, updates were still downloadable.

Oh wow. So if you don't plan to go online, why care if I get banned, I can keep updating my pirated games all I want.

Not that it matters, I assume sooner or later, Atmosphere will just have a homebrew app (like WUP-Installer on WiiU) that allow you to install games, updates and DLC directly on the home menu.

It is a risk.
Because a Switch cartridge has an Unique Code.
and when we all play the Dump from the same release group we all have the same *Unique* Key.
if nintendo want to ban they can easily.
Maybe we need a program like a keygen for Switch games, so that everyone has an Unique key.

What if nintendo bans because you used a third party jig, they could know you enter rcm somehow, we still do not know anything, as of know we really do not know what will happen, even the current bans are just speculation for why do they happened, some could say homebrew, some could say the cdn(it was mostly that be we do not know), even if bans occur with tx we wont know, in 3ds the bans were so random that to the current date, there is no specific answer
