I mean, 3DS was pretty safe with emuNAND.

That is because EmuNAND is disconnected from SysNAND and would stay offline. That doesn't mean what went on in EmuNAND was safe. Same with the Switch. Users do all sorts of piracy, hacking, and other bannable offences. They would be banned almost immediately once they go online with their EmuNAND partitions.

Dang it. The switch is too secure...
I just wanna find a safe way to save edit Pokemon and Animal Crossing, while sill being able to play with friends. From the looks of it, I don't think that's happening anytime soon or at all.

Consoles are only ever going to become more and more secure as time goes on since hackers keep finding exploits and loopholes in them. The very fact you were able to enjoy such conveniences in the past such as hacking or playing pirated games online is exactly what led to your undoing on future consoles. In fact, I wouldn't be surprised if piracy wasn't a thing on the next console. To an extent, that's the case with the PS4 past firmware 5.0.5 making certain games currently un-pirateable as well as the Xbox One that strives to undermine hacking with its Developer Mode (and the fact that the Xbox One is a glorified Windows machine).

Eh, I'm not really too interested in pirating games. I always try to support Nintendo anyway I can. I just like to mess with saves and backups and whatnot.
Plus being the physical collector type, it's obvious why I see piracy as useless to me.

You noted you couldn't access the eShop because you were on a lower firmware but didn't indicate whether you get an error code, such as 2137-7403, when you try to update your firmware which is the 5th question in the form which you also never seemed to answer.

I'm going to buy a new Nintendo Switch since I'm no longer working and I'm going to jailbreak it, how can I avoid being banned?

First thing you need to do when you get your Switch (after charging it of course), is a complete NAND Backup.

Then to avoid being banned, either keep your WiFi turned off, or use 90DNS. If you ever need to go online to the eShop or to download updates from Nintendo servers, you would need to do a NAND restore first.

You'd think that would make it more easy to hack :D

I don't intend to pirate games at all. Compared to other publishers, Nintendo makes my favorite games and I have no problem supporting them.

Only reason I cfw'ed my switch was to be able to do what I want with my games and saves.

...And the various emulators. Can't wait until hardware rendering is a feature on MelonDS. My 256gb sd card will be full of virtual copies of all my games from snes on up.

Ok so I've been running CFW and have been able to use eshop. The only difference now is that I downloaded an NSP on my SD card. So how can I get banned? How can Nintendo tell that I have an NSP when I installed it on my SD card and reboot my Switch without it being in CFW? Shouldn't all traces be gone? The only thing I can think of are game saves from the NSP, but that would be no different then borrowing a friends cartridge and saving a game? Why do I have to restore my NAND when there aren't any traces anywhere?

And if I'm bannable now than how can I surf eshop for DLCs/Games? Is there a CFW program that is similar to eshop?

Any NSP installed is a red flag. Someone else can explain why. Always have a backup of your nand before such things to your switch. If you're trying to download games/updates/dlc, you cant anymore off the eShop. The only way now is using google to find what you're looking for. Theres no CFW program that is like the eShop. Google and tinfoil are your only friends once you're banned

So basically I'm banable the second I add an NSP file? So if I accidentally click on eshop this time after uploading a file I'll get a xxxxx007 ban? And I heard updates were a bitch to get installed as well. So basically I just need to restore my NAND and for some reason Nintendo, which has a PRISM like mechanism collecting our information will automatically forget it and let me use the shop again?

Because .NSP files are installed with tickets which Nintendo can detect and subsequently ban. People have also been banned even after removing the ticket/using ticketless .NSP files. Same strategy is employed with avoiding a ban with .NSP files like any other hack; stay offline with CFW/homebrew and restore clean NAND backup before going online.
