Hardware nintendo knows i have an modchip?

i palyed Smash Bros DVD5 version for about 20h, yesterday i downloaded the DVD9 version. if i try to boot from it it gives me an error. The error says it detects an unknown device. if i boot the DVD5 one and swap disc it works perfectly.

so they can detect the modchip? can you explain me what exactly its going on?

btw: i have an wiinja deluxe
