Nintendo takes down the Breath of the Wild randomizer mod from Gamebanana

Another day, another Nintendo DMCA takedown against fan-made content.

Just a few minutes ago, Nintendo issued a DMCA takedown notice against a widely known and popular Randomizer mod for Breath of the Wild made by Waikuter and hosted in Gamebanana. Effective immediately, the mod in question has been completely removed from Gamebanana with the quote "This Mod has been trashed for a rule violation", with the rule violation in question being listed as "DMCA Takedown".

It's important to note that, as it has been the case with other recent takedowns seen from Nintendo, this was issued from the domain "mm-nintendo.com", which is a MarkMonitor operator for Nintendo themselves to issue these kind of take downs and notices.

It seems that Nintendo has started to handle takedowns in what looks to be an automated/bot process through MarkMonitor, as several other places with mods and Nintendo assets, like imagery and its characters, have been receiving the same notices from that mm-nintendo.com domain, like in the case of Gmod and its takedown of 20 years-long Nintendo assets, and it's worth mentioning that romsites have also been receiving these particular notices as of late from the same domain.

Considering the game is old now i don't see the point in ninty doing shit like this 😆
....old? It's still available on a console that's still supported...

Regardless, it's a mod... what the hell did it do that may (or may not) have violated any rule or law?

As consumers, we are understandably upset about it, but at the same time, it's also understandable why ninty is doing it from a legal perspective. Ninty is highly protective of their IPs, even more so for stalwarts like mario and zelda. They do it so as to not set a precedent which could weaken their legal position in future and their control over mods for their games in general. If they let one mod off, other mods could use it as a basis to justify their existence. So by regularly going after them, they firmly set their legal position of not allowing mods. It's just like trademarks.......if the company doesn't vigorously defend it, it could weaken their legal position in future. Case in point, minecraft company's scrolls vs elder scrolls.

As such, it could partially be due to ninty being genuine aholes about it and partially due to business laws (US ones in particular) compelling them to be aholes about it.

it's a fucking mod! they think they are gods now that they took down yuzu and can just make up whatever fucking rules they want to shit all over fan projects

o well the MM and SS projects are next than because these archaic old men have taken over apples job they are now officially worse than them!

This is a tough one. On the completely logical side, Nintendo is well within their rights to protect their brand. Anything using the name or even the likeness of a character is a potential target. On the emotional side, an opportunity to modify the game for a unique experience has been removed. On the frustrating side, that mod may never reappear, and others will be discouraged from making similar projects.

Personally, I feel a mix of all three. So, I can't fault anyone for how they feel about this. Feel free to attack my honor, quality of posts, and potential odors as you see fit.

Also, there may be more to the story. Like I said in a previous post, mods like Mario Builder 64 haven't been touched, but this project was removed after about two years of existence. If original assets/code were used, that's grounds for legal action.

I'm intrigued. What did Miyamoto do to Argonaut and Rare? I know Starfox 64 was handled internally by Nintendo instead of Argonaut, not to mention pulling the plug on Starfox 2 late in development. For Rare, I know they went over to Microsoft to make glorified mini-games and character avatars.
With regards to rare, it can be summed up as follows.

Shiggy: "this game is made like ass, it won't sell"
Rare: "lol, whatever" *gets greenlit to require n64 expansion pack*
Dk64: *one of the hottest selling games of the year, and of the franchise*

As for Argonaut, the Star fox 64 development was under his helm. Argonaut was tasked on Star Fox 2.

Long story short, argonaut was way ahead on making their milestones and feature stuff while Miyamoto's team was lagging. Shiggy threw another tantrum, and used legal to seize their work and pull funding, all but guaranteeing a slow death spiral.

That nintendo waited 22 YEARS, to release the game finally, first on the snes classic, is no accident. They waited for the company to be bankrupt, and for their leader to pass away, just so Nintendo didnt have to pay them in a strictly cynical and mercenary manner.

Credit due, Shigeru is a solid designer, but HOLY FUCK he does not handle being shined on by another person, let alone an outside studio, at all.
