Hacking Wii U reseller doesnt want to repair my device, screw Nintendo

Hello, last week i took my Console to my reseller (Saturn, its like gamestop) and they send it in for me.

They send it back not repaired and said they won't repair it because i installed a cIos on the vWii.
The reseller said i should talk to Nintendo or go to a lawyer, because im pretty sure that i have the right for my warranty allthought Nintendo said its gone.

What can i do now, or what should i do?

Just remember: Almost every company is trying to "break" certain laws and will only act after you notify them that you have a right to a specific service. As long as a) you still have warranty and b) the software mod didn't cause the problem you should be perfectly fine. Call them and tell them that they are obliged to repair according to eu directive 1999/44/ce. If he tells you some random bullshit ask him for his name and tell him that you want to be redirected to his superior. They will most likely be more helpful and fulfil your request.

I think going to Nintendo and saying "The LAW says you have to fix it" is a dumb move because I think that CIOS are only used for backup loaders and stuff. I think they'd just write back with something like "You want to get the law involved? How about your theft of our software?" Why can't you fix it? Is it a full brick vWii?

Nintendo will refuse to work on any device that has been altered for homebrew and/or piracy. And as far as I recall it's within their legal right to do so. What we all do when we mod our systems like that is void the warranty, not really any different than when you see a device with a sticker covering a screw hole that reads, removing this sticker will void the warranty (presumably because exposing the screw hole would mean you intend to take the device apart for whatever reason.

This.

You chose to purposefully mod your system, which in turns voids your warranty, and relinquishes any obligation Nintendo has regarding the repair of your system. Nintendo's warranty excludes user tampering.

Sadly, your issue lies with the reseller themselves.

Nintendo being the manufacturer is not your contract partner in this and thus can refuse your claim due to violation of their terms.

At this point, the burden is on the game store itself to prove your modification caused the issue.

(this assuming the console is more than 60-90 days old at that point)

Installing CIOS on the vWii means you no longer still have a warranty on it. To quote a great man, "It's all there! Black and white, clear as crystal! ... so you get... NOTHING!!! You lose! GOOD DAY, SIR!"

@DinohScene Well we got some other laws in Germany, the law that the reseller has to proof in 6 months after the purchase that you caused that issue if he can't you can afford a refund but my reseller is being a bitc* and says we cant refund that cuz Nintendo doesnt!

If you didn't messed around with the software then you probably would have gotten your money back.
Granted, the developments in Wii/vWii hacking is so good that it's hard to cause damage, but still.
Non official software was found on the system, so Ninty has the right to refuse it.

If I where to develop a gaming console which would be closed source so that only software I produce could run on it, I'd also refuse service on it as someone modified it to run things I don't approve of.

It sucks that they don't refund you but I can't disagree with them.

I'd say see if you can find someone who's extremely good with soldering and let that person replace the HDMI port.
Otherwise, scrap the Wii U for parts and get a cheapo used one.

@DinohScene I totally agree with you, but im not a lawyer or something, many people say that the Reseller (Gamestop) for example not Nintendo has to refund my Console and give me a new one, thats my only chance.
I have to get a bit more information before im going there again but this could be possible.
