Are you sure that the showing pink blocks are magenta?

The tiles that are displayed are ~70% transparent and ~30% Magenta... Will post screenshot later...
While I cannot say for sure because this might be a little different...
If you're using THIS COLOR to be transparent, then typically it MUST be 255/000/255 (#FF00FF) exactly at 100% opacity.
Typically, things that support transparency can use blank pixels to be transparent and don't rely on the #FF00FF pixels, though there are exceptions.

NSMBe5 uses standard PNG transparency and converts it to be used in-game as transparent. The tileset, for some reason, displays incorrectly/corrupted on DSTT and YSMenu, but on (so far) everything else properly.

Would it be legal to distribute an xdelta patch that modifies an included txt file to make my NRMB ROM?
It won't make a difference...
The legality of distributing the xdelta patches is already very questionable.
Having it do something else, like a text file, won't make a single bit of difference.

The worst that'll happen is you get a C&D from NoA.

I'm asking if I can include the txt file...

I know that it wouldn't be legal to distribute a NDS ROM, the current xdelta patch requires the original NSMB rom to work, but a txt file is legal, I'm sure...

I would be including everything required to compile a ROM from a few basic files, but not the ROM itself, so is it legal or not?

edit: what's a c&d?

And I'm saying it won't matter what you do.
It's not a text file or anything else that's the issue, it's the game patch itself that is of questionable legality.
Hell, you could include a link to the direct download of the ROM itself and it wouldn't make it any more illegal or less legal than it is (though GBAtemp would probably not allow it). It doesn't matter.
You're modifying code that is not yours, and under the DMCA, Nintendo can take action.
The action they are likely to take is at worse a C&D (Cease and Desist) letter telling you to abandon work on the project and stop distributing what you've done.

The reason that the worst they will do is send a C&D letter is because the DMCA is over-reaching bullshit of a law and (if you had the time/money/lawyers/resources) you could probably fight it and win.
If you want to see what the worst that will happen looks like, read up on Chrono Trigger: Crimson Echoes.

I'll just keep doing the patches for the NSMB ROMs of all regions......

edit: If I were to get one of those (doubt it, but possible...), could I still keep a copy for myself? Or do I have to delete it without a trace? (File Shredder)

You're supposed to completely delete it all from every source made available by you.
But really, IF --and that's a big if-- that happens then that will probably be the extent, i doubt they'll knock on your door to inspect your PC.
Once you remove the copies from any sites YOU have hosted it on, which seems to be Filetrip, your responsibility is at an end. It would then be up to Nintendo to go after anyone else who is hosting it.

However, all in all... this is a WORST CASE scenario.
There has been numerous Mario mods out in the past, so Nintendo's ground to go after your (or any other project for that matter) is very thin because it shows that they have not actively protected themselves from use of their properties in modifications, which is what set Crimson Echoes apart from the average mod: Square/Enix has and seemingly will continue to go after people who use their properties in modifications or other non-official capacities like the 3D remake of Chrono Trigger.

I also have it on MediaFire...

I wouldn't worry about myself being hit like that until Mario Forever is attacked (search for it on Download.com) It is a complete Mario game, made from scratch, whereas mine is only a level and graphics mod of one that already exists...

Back on-topic:

I have been working for hours to get the DSTT/YSMenu bug fixed, but no luck so far... Does anyone know of a way that I can load a game in NO$GBA using YSMenu? You know, load YSMenu in NO$GBA and then load my test ROM? My MicroSDHC card is going to wear out soon if not...

I have no idea but I just download the demo, gonna give it a go soon

That was the 'problem' with Crimson Echoes.

Anyway... I still think it's HIGHLY doubtful that you'll get anything.
There have been projects like this before for NSMB, and there have been more complex ones for other Mario games, like:

And the Automatic Mario series

I don't think it's possible to use firmware (things like YSMenu included) since there is no way for it to 'emulate' the SD card.
Even though YSMenu is packed into an NDS file, there's still a folder it grabs files from.

shud the mod work on all flash carts? not sure of the previous bugs but i have the R4i 1.4 with the recent update off of the official website and every demo i've tried, all the 'overworld' levels dont have any blocks whatsoever or there is a glitched pink item where the blocks supposed to be. the underground sections are all perfect but i'm only able to do so many levels because i cant see any pits/holes in level to see if its just early levels

I've noticed that the modified graphics don't show on DSTT/YSMenu
It's possible that your card might be based on DSTT or runs into the same issues.
