Nintendo awarded $4.5 million in Switch piracy lawsuit

A court has ordered Reddit r/SwitchPirates moderator James Williams (of ArchBox fame) must pay Nintendo $4.5 million in a default judgment for copyright infringement. The fine was estimated at $150,000 per title across 30 specific copyrighted games.

The defendant, who failed to respond to the 2024 lawsuit had previously operated online shops offering up Nintendo Switch ROMs and other copyrighted Nintendo material. With some light doxxing from their trusty ninjas; Nintendo managed to track him down and filed the lawsuit against him.

Unsurprisingly; beyond the multi-million-dollar penalty, the court issued a permanent injunction forcing him to shut down his distribution networks and associated social media accounts.

Wait, I've been a lawyer for a number of years and now you're telling me that after getting served with a multi-million dollar lawsuit you SHOULDN'T just delete your Reddit account and ignore it?

Next you'll tell me that if I lose all the money I invested in high risk stock options that deleting Robinhood won't solve the problem.
 
IIRC, Ninty actually tried to give him an off-ramp instead of going for the nuclear option straight away. They first tried with multiple cease and desists and he supposedly even agreed to it, but he still persisted anyway.
That's crazy. He must've had hero complex or something, but rather than dying a hero, he's a laughing stock and probably won't be remembered for long.

can people like this just stop? they make the whole modding/emulation scene look like we are just a bunch of dirty criminals trying to make money from other people's work. these high profile cases with big dollar amounts attached to them are what gets attention from the mainstream and people from outside of the community are just going to think we all are like this. game preservation becomes more difficult because of people like this. i'm glad they got what was coming for them
 
To be fair, this guy is a total muppet. Trying to make a profit distributing pirated material, particularly Nintendo games, is a stupid idea. And then he bloody ghosts the court. He was asking for it.
And he deleted his Reddit account to cover his tracks, but that doesn't stop the fact that Nintendo knew where he is, and can raid his home after warning him many times for selling pirated games. He's at fault for it, and was well aware of what he was doing. People like James puts the homebrew & hacking community at risk; some don't hack their console to pirate games but to develop ports and other projects that keeps the consoles alive. And unfortunately, companies like Nintendo & Sony will continue adding security measures to make them no longer viable to work with.

If a case against you ends in a default judgement, you have no one but yourself to blame. You de facto admit 100% liability by refusing to respond. He tried to profit from this and was not some preservationist. Let's not have any sympathy for an organized criminal here.
