As far as I know you always have to take action yourself before an update is actually installed. It won't install on it's own.

No but it will pester you regularly when turning it on to update, just have to make sure to say no. Irritating but only trouble if you have someone else using your 3DS who doesn't know.
I wonder if there'll be some Gateways for sale cheap a week after they come out and some people discover they can't use 'em.

The iEvolution allowing DSi-mode homebrew got people excited, but due to the nature of the exploit there is NO Wifi access at all in DSi-mode...
