Hardware New 3DS XL Occasionally Doesn't Turn Off?

I have a red N3DS XL with custom firmware installed on it. Recently I've been noticing a problem where sometimes, when I hit the on screen power off button, the system doesn't actually power off and it kills the battery, like today when I had thought it shut off last night. Is there any way to cure this or avoid it? Having an unexpected dead 3DS is really lame.

Make sure the LED turns off?
And if it doesn't, hold the power button down for 10 or 15 seconds, I forget which.

    I don't have a wii u anymore to test it myself, but if homebrews are not visible on the wii u menu I think you can press L + R + minus to open the plugin menu, there should be an option called "homebrews on wii u menu" or something similar

    Or when your player dies, you can say in code, if enemy exists, do nothing, but if enemy does not exist, then create enemy at certain spot. (This would be a pain tho for lots of emeies)
