my guess is that it's for indexing purposes (so the game appears on the home menu). a lot of time that's the reason for needing a game or a save beforehand. I just recently figured out how to inject a ds save into the wii u from a flash cart, but I made sure a save already existed for the game. it may or may not work without one.

I don't. it's probably an official game, but I really don't know. I've never injected vc aside from a couple wii games.
