Ah so we're still using the same method Gateway used for their EMU string. Is there anything Gateway does right at this point?
Alright. I had it on on my n3dsxl b9s 11.4 and I haven't been banned yet. I see you're from the US, your wave might have already been over.

What if the ban ID triggered because in system settings the versión says SYS instead of VER or what if the cia's tickets have a serial ID And is like public And private headers?

I had it enabled on both of my consoles, but only one was banned. I've disabled it from the other just in case.
The banned one is an Old 3DS running 11.2, A9LH and a nightly build of Corbenik.
The one that was not banned was a 2DS with 11.0, previously using A9LH and Corbenik, now it is B9S and Luma.

if this is legitimately the reason for the ban waves (which, i should point out, since 99% of CFW users prolly didn't know this setting existed at all and never touched it, more people are likely to say yes so the poll might be a bit misleading), would there be a way for a B9S installation to automatically disable it, if not lock it out completely?
I posted in another thread that I called Nintendo CS today, and now they said it's permanent.

no need to search what is the cause, look like they have the power to see if a console has been modified, nothing special, now they want to ban cfw, and if you don't want to be banned just disable internet on your console, rip cfw, it was fun.
It is very likely that some people are being banned if the setting to share information with Nintendo is enabled. If there's no record of CIA-installation in the activity log, and the user isn't doing anything else, then my assumption would be that the console wouldn't be banned.

Well, I'll try going online in a month. If not, I have a couple of busted consoles that I can probably harvest for the relevant files. Most annoying thing is probably the crap I have in the Pokemon bank, but that's how it goes.
Nintendo isn't Sauron. They can't magically see anything. It's a question of what they are detecting and how they are detecting it.

It's too early to say RIP CFW.
- CFW is great regardless of the ability to play online.
- 3DS online play is probably going to end for everybody within the next couple of years due to age.
- Once we've figured out what's causing the ban, unban methods and ban-prevention methods are likely to sprout up.
Mine was disabled, for a long time, at least since the dawn of 11.4, acknowledging the possibility that the settings revert to default when updating firmware. I still got banned.
