Just because there are zero bans doesn't mean its safe. The fact is, the information is there for Nintendo to see. As long as that possibility exists, the only way to be safe is to stay offline.
You call it a fact and then you call it a possibility. You're right on the latter. But if Nintendo does log this information, we don't know how far back it goes or how many details they have. I'd say it's safe to assume we'd have a lot more bans if they were nixing everybody who has ever used a public header online, let alone everybody whose private headers haven't matched their cart IDs in the last two weeks.

Is staying offline even a certainty? I mean, technically, if it doesn't exist now, Nintendo could feasibly patch in a system that logs the booting of software checking for whatever they want (header information or whatever else). And then whenever the 3ds goes online, it would send the pertinent information from this log to them. If that were to happen, and I don't see it out of the realm of possibility, the only recourse would be for someone to develop something akin to PSN Patch for Playstation 3 consoles on CFW. I mean, as it currently stands, sky3ds users are either running software with public headers or with no headers at all. So many flags to chose from. And don't get me started on Gateway. How this system is secure from Nintendo's prying eyes is beyond me. It's almost like Nintendo isn't even trying.

What I'm trying to say is I don't think it's in anyone's best interest to claim anything is safe from a ban. You should be aware that you could be banned for any reason whatsoever if you partake in activities against Nintendo's TOS even if you think you're "being safe".

Not trying to spread FUD or disinformation. I admit that I'm certainly no expert.

Absolutely. In fact, I've heard you can even still connect to the store. Just banned from multiplayer from what I understand.


So trading and battling with friends locally on Pokemon and Smash Bros still works even when banned?

Wow.. You know, suddenly I'm a lot less afraid. That's all my secondary Japanese N3DS is used for. haha B-)

No, read my post more carefully. We know for a fact that Nintendo can see your header information. Whether they will act on that information is a possibility. True, no one has been banned YET, but you cannot assume its safe because they could easily start doing so in the future.

Doh! I'm sorry, I misunderstood your question as offline play. My bad. I don't actually know if being banned will disrupt system to system multiplayer.

I meant we don't know what other information they can see. Whether a private header conflicts with the cartridge ID, etc.

Besides, have you considered that if they start banning people for using private headers and .CIA files online, we'll all be forced to only play offline anyway? Whether you're doing it to avoid a ban or because you're already banned won't matter at that point. So you might as well get in what online play you can in the meantime, should you expect that to be an inevitability.

I didn't say private headers are guaranteed safe for all time. I said they're safe now; they're safe until they aren't.

Oh no worries. It wasn't originally my question to begin with. My Japanese N3DS is just used for local Pokemon trading, and just waiting for somebody to report whether or not their banned 3DS' can do this.

Going to just stick to dumping my own roms, or playing downloaded roms offline only for now. :)

I didn't say private headers are guaranteed safe for all time. I said they're safe now; they're safe until they aren't.

The only way they would not be able to tell if a private header did not belong to a cartridge is if Nintendo does not keep track of unique ids for every game they sell. I personally find that extremely unlikely but its possible that Nintendo was really that sloppy.
Another possibility is if you go online with multiple games using the same private header, they could know. That information is presented to Nintendo.

Also, to say that private headers is 'safe' now because no one has gotten banned yet is faulty. You are still putting yourself at risk for reasons I wont repeat.

By Meteo's logic, even turning on wifi is a risk. Living scared is not living at all.

Safety is indeed a relative concept, but in this context, I would argue that at the moment, the risks are great enough to say that going online in any form is not safe due to lack of knowledge of how seriously Nintendo wants to stop piracy. Will Nintendo begin to clamp down harder? Only time will tell. For now, my point still stands.

The whole point of the ban is stop people from going online. If you stop going online voluntarily, then you've already banned yourself without Nintendo's help.
Since Nintendo will never divulge their method of piracy detection you will never have a definitive answer to ensure safety, so you must ban yourself forever, not very logical if you ask me.

Well, staying offline does ensure safety. I'm not suggesting people stay offline forever. I'm only saying that going online puts you at risk. To think that you are safe from being banned because it hasn't happened yet doesn't mean you wont be banned.

Right now I've been playing MHU4 EUR online on my USA XL, with a private header made with a old offline only game.

So I can say its safe to use private headers for now,
and till someone is banned with it; It's still safe.
