They still have to make money after all, and making their own red card obsolete is rather counterproductive.

In the video, Gateway are intentionally neglecting to show exactly how their exploit is executed.

maybe it wont allow you to install DevMenu as a .cia ?
Also how would you go about getting a refund anyway? Not to mention most of the flash cart selling sites have strict returns policies that would probably make you eat up a bunch of shipping fees in the process.

If the website refuses to give you a refund, just charge-back on paypal, or your credit card. Its not hard.
How is this in any way fraud? At best it's exploiting a store's return policy, but it isn't fraud and it isn't illegal.
EDIT: Err... In hindsight, maybe you weren't that serious to begin with.
