No. You can't run emuNAND without the Gateway card in your 3DS.

It's possible, but they will probably put some sort of check in there to keep the exploit from running without the card.

They still have to make money after all, and making their own red card obsolete is rather counterproductive.

Maybe, but that doesn't mean that Gateway already has emunand working on 9.x

Also how would you go about getting a refund anyway? Not to mention most of the flash cart selling sites have strict returns policies that would probably make you eat up a bunch of shipping fees in the process.

If the website refuses to give you a refund, just charge-back on paypal, or your credit card. Its not hard.

How is this in any way fraud? At best it's exploiting a store's return policy, but it isn't fraud and it isn't illegal.
