Ubisoft is the publisher not the creator. Ubisoft are very much alive and well, they are the 3rd largest publisher in the world. This story about the game being unpatched due to bankruptcy is something of and urban legend. Ubisoft more than likely own the rights and would not object to Nintendo patching the exploit if it were possible. There's little incentive to do so however as the cartridges are like hens teeth.makes sense

They can not. Update data is linked via SD. When it's an eShop title, they can force update. A cart cannot be forced to update. All the data is stored in the cart.Yes they can, will they? Probably not.
