The game was published by Ubisoft. It was developed by a company named AQ Interactive, which is now bankrupt. Ubisoft might be able to do something, but I doubt they have the source code, and I doubt they care.

Even if they DID care, Nintendo can't force people to go online and update a cartridge game. They sort of can with eShop titles (as they were downloaded from the internet anyway), but they can't block a random kid with no internet access from playing a legit cart of Cubic Ninja.

Ubisoft is the publisher not the creator. Ubisoft are very much alive and well, they are the 3rd largest publisher in the world. This story about the game being unpatched due to bankruptcy is something of and urban legend. Ubisoft more than likely own the rights and would not object to Nintendo patching the exploit if it were possible. There's little incentive to do so however as the cartridges are like hens teeth.

They can not. Update data is linked via SD. When it's an eShop title, they can force update. A cart cannot be forced to update. All the data is stored in the cart.
