Misc Nintendo online has changed... And that is not good

So I own a lot of Nintendo stuff. From old to the newest consoles and handhelds. The special thing with Nintendo is that they are different. They lack the balls to copy other companies, but why should they? Almost everything (except the virtual boy which I found pretty nice for that time) is a cash cow.

Only the nice part has come to an end since April 2014. The digital age is taking its toll on Nintendo. Attached is a screenshot that tells the following:

I hereby give Nintendo permission to only deliver digital content for the period of time that the recall period is active. I declare that I take no further action to make this sale undone.

In other words: no money back on digital stuff. I guess they learned from the last batman dlc season pass.
So that means they can bullshit you pretty much with everything they do. Removing things from the shop is not a problem anymore because you agreed on the terms that they are boss over your console. Which brings me to the next painful point: they can erase software from your Wii U without asking. Don't believe me? Read the TOS of your Wii u online services. There is the option automatic update after you power down your console to do "certain" actions. Normally it will patch software or download updates when they become available. Know they can also remove any software they see fit.

What of you think about this? And do you still use the automatic update service after knowing what can happen?

The ToS of the online service does not have priority over the license that comes with the game - they're two separate entities altogether. Nintendo can't randomly remove software from your system - they can deactivate software that you've downloaded illegitimately or if you've otherwise violated the software license - they've done so in the past during one of the promotions they had with the 3DS when people downloaded more copies of games than they were entitled to.

So I really not need to worry then? Because why this warning then all of a sudden? Last week I did not receive this message.
You're getting a message about a change of the Terms of Service, Nintendo has the legal obligation to inform you about any and all changes to their policies if you are a user of their service and they need you to acknowledge the changes.

This is weird... The post looks fine on my iPad? (had nothing else to take the picture with so had to hold it upside down.) Strange though it ignores the position.
