Hacking 3DS XL bundles 4.5 fw

All 3DS XLs bundled with Monster Hunter 3, Mario Kart 7 and Mario 3D Land came with <=4.5. If the same bundle is made today, will the 3DS XL have a higher fw? Or is it safe to buy a bundled 3DS that it will come with the 4.5 fw? Is there a chance it might not?

I suppose to this day these bundles are still being made? My question would be if a Mario Kart 7 / 3D Mario Land / Monster Hunter 3 3DS XLs bundles came with firmware before or equal to 4.5, if the same bundle were produced now, in 2014, the 3DS XL would still be patched with the 4.5 firmware or with the newer 7.0+ firmware.

Of course they would have higher than 4.5 if made today. Silly of you. So, if they still make those bundles, you need to watch out for the newer ones.

Those bundles are 'limited edition', so one would think these aren't being produced anymore. Has anyone gotten a MH3 with a fw not 4.5?
