When i transfer my Saves Apps etc. from my 3DS (ver. 5.1)
To my new 3DS ( ver. 4.3) will it only transfer the Saves etc. Or the version 5.1 to?

Just use a forwarding service like Tenso. They only charge a ~$5 service fee and you pay the actual shipping price to your country through EMS (or SAL, I think).

I've used them in the past but getting a Japanese seller to confirm it says 2012 on the box itself is turning out to be very difficult lol

What are the chances any of the systems have anything over 4.5 though? The black 3DS came out last week and only has 5.1...

No idea honestly, I haven't read about it either way. So if there's someone that can confirm what the highest firmware shipped on their ll I'm open to hear about it.

I'm pretty sure you need to update the 3DS to use the system transfer tool. For the save tool it looks like it's only available starting on 5.0. I have a similar problem where I just got a new 3DS XL and want to transfer a downloaded eshop game.

Yes!

Put Luigi's Mansion or Pokemon Mystery Dungeons into your Gateway and you shall be golden.

By the way, just as a heads up, do avoid 5.1 ROMs as they prompt you to update to 5.1.

While 5.1 came out 2 weeks before that bundle did, 5.0 came out another week before that. So it's entirely possible that it has 5.0 bundled with it. I'd try google.

It is safe. I bought mariocart 3ds xl bundle and it has 4.3 FW

I think you can just get it and you will be fine. The old bundles are safe.
