Ah, so you've seen the logs that the rest of us haven't! You're sure they weren't trying to do exactly that? Is it because m4x said that's what happened? Why would chat logs exist in "the team" group chat 6 weeks after initial contact? From my experience with TX "execs" (both before and after the X360 stuff, which makes RA's post even funnier to me), if an offer comes in, you can stipulate anything reasonable in the counter offer.
TX *clearly* doesn't care about FOSS or licenses, but I can guarantee that they cared about doing everything to make a deal happen with m4x, and get this RetroSX thing made. If m4x actually brought up the topic and insisted on figuring out a way (I'm sure he did), then I promise he was heard and solutions were discussed. I'm guessing talks fell apart over the summer, but they CERTAINLY were not rebuffed from the beginning (or even in the midst of it, it seems)
Like I said, this whole debacle is just "haha, jokes on them, I was only pretending to be morally bankrupt for 3+ months!"
