Hacking Question about "update nag"

I just want to make sure in which situation the "update nag" will appears

# immediately after few minutes being Online
# or I must be in sleep-mode

It's important to know because the new exploit seems
to require internet + Also it's seems there isn't EmuNand
so we gonna playing online on sysNand

Well its not confirmed yet. But just so you know,

The update nag will appear when you boot up the 3ds. So far my 3ds left in sleep mode hasn't nagged me. Only when i turn it off and on again.

Even that depends on your system because there have been mixed reports

You won't get an update nag because the update happens too fast for anything including the system update to download.

I never turn my 3DS off but I still see the update some times when I go to home screen. I'm on 9.2.
