yeps ..ask the seller to show he can access friends list as a proof that it's not banned.

It's still bad if they sell it as an used 3ds without mentioning the ban. It can be difficult to claim it wasn't you afterwards, unless Nintendo support can give you the date of the ban (which I doubt).
