Hacking [Poll] Bans and "send information about the console to Nintendo"

I found out that I had the option enabled, and quickly turned it off. Then I connected to internet, and luckily still no ban. System: N3DS

That's pretty significant, even ignoring that some of the poll results probably aren't right.

Went to friends list for a bit today and made sure I am shown as online. No error message. Didn't stick around though. Always had that, auto downloads, and pretty much everything like eshop's sending of anon info, to off.

I had it off on my n3ds XL since i started doing hacky stuff with it, not banned... yet.... Can't test if i was banned on my o3ds XL yet, because i haven't used it in ages and it still runs 11.2, so i can't go online

Like I hypothesized in the other thread, this could be the culmination of months of work by Nintendo, and they might have a long list of ways to ban people for this banwave. For example, one person might be banned because this setting is on, but one person might be banned even though the setting is off because he or she used ctr-httpwn.

I had it enabled but I remember disabling it the first time I got my 3DSXL back in 2014... Never formated but did a system transfer some days ago, that might be the cause to be enabled again, I suppose.

So, not banned and I had it enabled.

Good grief this is all so confusing. Maybe everyone with CFW will get banned, it's just they're only doing some at a time. Which points back to activity log, no?

I just checked and my Spotpass settings are still set to OFF. I remember them being ON at one time last year and wondered: "Wait why are these on? o.o" because I was sure I disabled them when I got my new 3DS. So I'll see if the while I have been online with ReiNAND last year has flagged me. So far I seem to be fine thankfully. One question Aurora, if Spotpass is indeed the cause for all this mess would Luma have the ability to force Spotpass being off at all times?

Had it enabled by default, but with every "Would you like to share your play experience with Nintendo [...]" I was greeted with, I always said no. Not banned as of now.

Now since you thought it was disabled... how many of the "it's disabled and I'm banned" are actually true?

Mine was disabled when I checked last night, and my memory at least stretches to Monday. But I'm curious about something. I think last week some demo of some game downloaded into my banned 3DS, it certainly did on my still unbanned 3DS with a JPN region swapped Emunand. Does that affect the spotpass settings? I know for sure when I checked out the JPN Emunand's system settings, the sending of information and the automatic download of software options were disabled. Though it's in Japanese, so I don't know if they switched positions where No is on top, and Yes is on the bottom. My settings selected were on the bottom. If the one-off automatic downloading of some demo had no affect, then with surety I say that the Spotpass settings were disabled.

N3DS XL EUR with the option enabled - recently installed B9S, had freeshop, Pokemon, custom themes...
Not banned.

I always disabled the option to show what software I'm currently using.
It probably doesn't make any difference but I just don't know how I didn't get banned yet.

Well i had it activated, but I'm not banned. Ofc now I turned it off. I mean, just to be sure xD

Today I checked the Friend List of my B9Sed 11.4 2DS, and I was not banned. A few minutes ago, I disabled the wireless connection and I checked if I had activate that option of the sending informations. I thought I didn't enabled it, instead I enabled it time ago, but I didn't enabled the "Automatic download" option. Then I unenabled the "send informations" options, and I reactivated the online. It was all ok, not banned.

P.S. In the Luma settings, I activated just "Splashscreen - Before", "Enable game patching" and "Show NAND string" thing

Based on these results, I'm making the following predictions.

1. Some, if not many, of the unbanned people with this setting enabled are in the banwave queue.
2. Nintendo is likely using this setting as one way of banning people, but it's not the only way they're banning people, since some people with this setting turned off have still been banned. They've probably been preparing for this banwave for months.
