Now since you thought it was disabled... how many of the "it's disabled and I'm banned" are actually true?

I think last week some demo of some game downloaded into my banned 3DS, it certainly did on my still unbanned 3DS with a JPN region swapped Emunand. Does that affect the spotpass settings? I know for sure when I checked out the JPN Emunand's system settings, the sending of information and the automatic download of software options were disabled. Though it's in Japanese, so I don't know if they switched positions where No is on top, and Yes is on the bottom. My settings selected were on the bottom. If the one-off automatic downloading of some demo had no affect, then with surety I say that the Spotpass settings were disabled.
