Pretty sure the files are deleted from the system.

Nope, the files are packaged differently on 3DS I think, but I heard you can extract a .nds file from a DSiWare game on 3DS.

i know, i did that with cave story, you just rename the *.app file to *.nds
but i want to get back 4swords and install 4swordshax
also for some reason i can't redownload it, but it was a free title :/

You can't re-download it because once you transfer it to your 3DS you can no longer access it on your DSi. The only way you'll be able to get it back is with a hardmod, fwtool or hiyacfw.
