Okay so I have another assumption. Assuming somehow Nintendo will eventually dish out bans for CIA files I wonder if it'll always be safe to play offline CIA files. Or what if you play CIA files with online capabilities offline, and then if you ever want to play them online use savedatafiler to use the saves on the .3DZ version of the game (with private headers). That sounds like it should be safe in my (as limited as everyone else's) opinion.

And obviously it'd make more sense at that point to just only use .3dz files but I'm curious at the possibility

Does the ban may be related to downgrades using .dg files made available by the gateway? What is the SysNAND version of the people who were banned? Downgrade was made?

I have a 3DS XL with factory firmware 4.5.0-10U and EmuNAND 9.5.0-22U.
I online game using .3dz files with public headers and I'm free.

I can't keep up. 20 pages since last night. This is as bad as the Hype Train. (Slightly more productive I assume)

So if you use the same header for two games, but it is a legit header, will it result in a ban?
My theory is as long as that header is online only once it will be fine. So even if you had it in 30 different games, you can only actually play 1 game online at a time. Thus the header is only online once.

no because its mostly happening to sky3d users they do not downgrade

stop using public headers

Safe, for now. But it seems possible that it really is public headers that cause the banning to trigger.

And Sky3ds users are getting banned too, so it shouldn't have anything to do with your downgrades, since sky3ds users don't use that.

Has anybody that has been banned tested if they got banned on the Wii U as well? Using the same NNID obviously.

Okay, spoke to nintendo. It's definitely a ban. I don't know how long for and what for, maybe they're starting to crackdown as I use a lot of public headers instead of my own. So beware I guess. Told I will have the full reasons within 5 days.

For any new reports please use this form provided by MrJason005:
Code:
What flashcard were you using (Gateway or Sky3DS etc):

What game were you playing:

What was your sysNAND firmware version when playing:

What was your emuNAND firmware version when playing:

Were you using a .CIA or a .3DZ:

If you were using a .3DZ file, from what game was the header you were you using:

Header Name: e.g CTR-P-AGGE, CTR-P-BALE (these are the two I used when banned)

If you were using a .3DZ file, was the header public or private:

Can you visit other online Nintendo services such as eShop and Miiverse:

Does that ban apply to just that game or every online game you try:

Any Additional info:

I would add what region console and rom version you where playing ... who knows Nin might ban people playing games of a different region :P

Seemed that if anyone bought a retail cart from whom published the game's 3DZ, his/her console would also get banned, even he/she didn't play piracies.

Since people are claiming to still use public headers online without ban, I wonder if it's just over used headers being banned. Maybe a public header used 20 times at once isn't getting banned, but one being used 21 times is. Maybe there is a hard cap on how many times a public header can get away with being online now. What if Nintendo sees a header being used far too much and that triggers it?

Why would there be a cap? If someone is using the same header twice at a time, how could that be anything other than piracy?

Who knows. It's Nintendo. But so far it looks like they are attacking the most public of public headers. It's just a guess but maybe they don't check unless it's really being over used hard.

Or maybe they're only banning those using blacklisted headers (perhaps mainly/only Sky3DS headers?), and non-blacklisted public headers are still safe to use?

Most likely no. Not everyone banned downgraded. Especially if they were using Sky.

It's been tested and they were not banned from both. I think that's because it would be pointless for Nintendo to potentially lose revenue (you can't pirate Wii U games, so all games there were obtained legitimately).

Tis a risk they're willing to take.

That can be. You'd think that they could just go to the Sky template, take all of those headers and then do a massive ban.

I'd like to bump my question. Thoughts?

Either or. Probably the latter. Maybe they see one is being used X times and it black lists from over use. I wish I knew. I just know I feel really safe using my own header from an online game I will never play anyway.

I don't think there are safe public header it's an alarm because it's on the same means nintendo could get them, possibly is a matter of time until they blacklist all public headers

I do not understand Nintendo.
This idiotic idea of banning hardware is going to cost them money and goodwill. This is clearly a case of the right hand not knowing what the left hand is doing.

Dear Nintendo,
You can not issue a hardware ban on NEW 3DS' when you stupidly removed the serial numbers from those packages.
Expect many 'happy' returns from banned consoles owners and 'unhappy' returns from people who unwittingly purchased those returned consoles.

You act like they're the first company to ban hardware from accessing online features when the hardware is used in a manner non-compliant with the ToS/EULA. We're the ones breaking the rules, it's up to us to keep ourselves safe from bans as best we can. It's not up to Nintendo to stop banning.

Your outrage would be justified if they actually bricked consoles, effectively making us lose the money we bought the console with, but that isn't the case. They simply stop you from being able to use their online services, which is well within their rights.
