you get an error? you will probably have to force the user agreement to 'accepted'. you can do this with the dev tool 'config'. it's out there somewhere, it's a .cia file.
i honestly can't tell you where, i don't know because i have not used it myself, but google 3ds dev tools, dev sdk, etc, and i think you should find it we are not allowed to share it on this site.
