Yep, nobody is debating that. Thing is, from the ban reports and what i have seen, it looks like the information Ninti is getting is not enought to determine if the games im playing are legit games or not, so i could assume they get info like playtime, game version, etc, but not stuff like game certs/headers, etc.

Again, all this is if your Switch is connected to the internet at some point, but not actually playing games online like Splatoon 2 matches and that stuff and obviously on OFW. This is all speculation, tho.
That information is gotten when you try to play online with those games. THEN, Nintendo determines whether its legit or not.

Nintendo can see which game you play when you update it through their servers? SHOCKING!
Nothing to worry about tbh. Would also happen if you borrow a cartridge from someone and update it there. All this "Nintendo can detect when you play the Switch on the toilet and ban you" is really getting annoying.
Try not to update too many games in one day, spread them out over several days. A person who updates like 20+ games a day will look very suspicious.

Also, it's a good idea to remove the SDCARD when you do your update online.

I too got an email from Nintendo for playing Zelda. Funny thing is I updated a bunch of other games too but Zelda was the only one which I played and the only email I got. So I'm pretty sure Nintendo kept track that Zelda was played and the rest weren't even launched.

FWIW I'm still not banned.

I'll confirm this too. Only ever had MK8 on cart on a different account. Just updated the BBB release in OFW using + menu (didn't play it or take it online) and I just got the same email. Only just started using that email/Nintendo account a few days ago as a disposable one for this console.

They know. But so far I'm on my like 80th game updating and haven't been banned yet. I'm fine with them banning me after I got all of the updates, never plan on using this console legit again :rofl2:
They're probably waiting to keep people who use CFW on their toes so that people can't predict and try to stop it.

I looked at my email today and seen an email from Nintendo thanking me for playing Mario Kart 8 and a few other games and the funny thing is I have not played them online only play it offline I do boot into ofw to update the games don't know if that is why i got the emails or not but iv not played any of the games online or been online with sx os besides checking an addon for breath of the wild like it asked and that took 5 secs and activating the key other then that no i have not and i am still not banned but i do have it set to were they don't get my error logs or anything so i do think that has helped as iv had a few of them that they don't need to see.
so i'm 100% sere they know what i'm doing now so how long do you think i have before they beat me to death with a hammer?

Edit--------
They emails are asking me to redeem gold coins for the games iv played and I know better then that.

I was bored so I edited your original post by slightly revising the grammar and adding punctuation so it's easier on the eyes. The message you were expressing is still there. Please don't take offense. I was just really bored and wanted something to do while I waited for my breakfast. lol

Today, I checked my e-mail (see below) and there were messages from Nintendo thanking me for playing Mario Kart 8 and a few other games. I even received a message asking me to collect my rewards and redeem gold points as well (but I know better than that.)

Funny thing is, I haven't played any of these games online. However, I did boot into OFW to update these games. I also activated updates for Breath of the Wild when I was prompted to, which only took a few seconds. I don't know if that is why I received these e-mails?

Anyways, I opted out of sharing error codes with Nintendo by disabling error reporting in the system menu, as I did receive a few errors and they don't need to see them.

So as it stands, I am not banned as of now. I am 100% sure they know what I am doing though. So how long do you think I have before they beat me with the inevitable ban hammer?

Email Proof:
Mario Kart 8 Deluxe
Splatoon 2 (First half)
Splatoon 2 (Second half)
Kirby Star Allies

I like this! To be far in school they never taught me how to use or were to put punctuation's just did what ever and will here I am 27 years old been out of school for years even did some college.
the school systems in the part of the US that i'm at are not very good.
I really should take to the net and learn all the punctuation's and how to writing a sentence correctly.

if this were the case they'd also ban people with a clean console as well, there's a good amount of people that chunk buy games and then update them all at once

What part of the US did you attend school? Punctuation is part of elementary school. I'm not dissing you, I'm just worried about the children in that area. It sounds like the school system is severely jacked up. Your state lawmakers need to do something. I'm guilty of not using proper grammar and sometimes not putting in punctuation marks. It's my laziness though. Yours is the fault of others. Poor teaching skills. You can make change happen though .attend town hall meetings. Take to social media. Also, use spell check. Lol.

Nintendo sent him spam and he's paranoid it might mean he's on a banlist or even just a watchlist.

Updated the game in OFW, got the following email this morning:

Updated that game a few days ago (legit cart, no SXOS or other hacks/mods) never seen an email from Nintendo. You guys probably left some marketing option set to ON in your accounts or something...

I agree. To OFW the games just look like carts you inserted and then removed. What if I just bought a used Switch with like 40 games with it... am I not allowed to update all of my games? I doubt that alone is enough to get you banned... that said, there's probably enough of everything else on your console and SD card to squeal on you anyway no matter how hard you try to hide it.

If Nintendo really wanted to ban people playing backups couldn't they just run a check to see if you have xci files on your sd card? I mean a lot of people are coming up with complicated convoluted theories about the ways they will find you and ban you but yet Nintendo is going to miss out on the obvious and most accurate one?

Was this game you never had nor play before? I don't ever remember anything (at least on the Switch) about receiving/canceling marketing. However I never even logged on to mynintendo.com website

Also note, it is only specific Nintendo's exclusive titles, like Zelda, Mario Kart 8, Super Mario Odyssey, and Mario Tennis

Kentucky sadly. And the state knows about it and they are the ones that will not do something about it. Also for every other person i'm still not banned yet.

Hello, fellow Kentuckian. Yeah, the schools can get pretty shitty out here. I was lucky enough to be raised in a part of the state where they actually put a decent amount of funding and effort into education, but where I live now I hear things are absolutely terrible.
