This is why people who claim that updating the games is not detectable by Nintendo when it clearly is. The most likely reason that bans have not been sent is because they want to keep us on our toes. I can assure you that no matter how many people were banned with LayeredFS, there are twice as many people NOT banned. Anyways, if you can provide some proof OP, that would also be greatly appreciated (like the e-mail, kinda hard to claim you don't own MK8).

EDIT: There's also the possibility that the data is not shared equally, which would be really weird because the marketing team knows what you do better than the banning team.

I'll confirm this too. Only ever had MK8 on cart on a different account. Just updated the BBB release in OFW using + menu (didn't play it or take it online) and I just got the same email. Only just started using that email/Nintendo account a few days ago as a disposable one for this console.

They know. But so far I'm on my like 80th game updating and haven't been banned yet. I'm fine with them banning me after I got all of the updates, never plan on using this console legit again :rofl2:

Even the profile data most likely will contain a few info about the games played (they are tracked in the profile on the switch that also shows the hours of play), at least on other consoles there was even some clever stupid devs who saved game data into the profile file on the Xbox360, some games instead of hacking the game save we would hex edit the XBL profile...

The email you received from Nintendo is a trap. It temps you to redeem the Gold Coins, if you do that - you will be caught with your pants down and BANNED. I can see some dumb kids doing that after they got a friendly email from Nintendo.

So fill me in, this means if you have your copy e.g MK8D it registers,
then when you make a backup and use it on the same account it registers again?

Infinite gold points

They would definitely know if the same unique ID registered on the same device/account twice and I'm not sure if they would perceive it as in error or if it happened multiple times be thinking, this guy must be breaking our ToS by backing up his games, lets ban him. I mean if people actually had infinite gold points would be funny but as someone who does "backups" I doubt that would be useful even if possible :rofl2:

i love to see when the cry babies come out about being banned.... you are running exploits that erm is not nintendo's product thus not supported, these exploit the console to bring piracy which again is breach of nintendo T&Cs..... when running said exploits you run the risk of being banned.

if you want to run exploits, keep your system offline.

if you want to play online, then do what the rest of us do and buy your games.

Is it just a North America thing? I've never received a single one of these emails for any games I've bought and played.
Nope, I am from the old countries. I received two emails, the first one was "have you finished MK8D already? you might enjoy these games as well" (paraphrased), the second one was "we're happy you're playing Odyssey, hope you enjoy the game. Here's some tipps: use amiibo..." (also paraphrased)

Nintendo can see which game you play when you update it through their servers? SHOCKING!
Nothing to worry about tbh. Would also happen if you borrow a cartridge from someone and update it there. All this "Nintendo can detect when you play the Switch on the toilet and ban you" is really getting annoying.
