I looked at my email today and seen an email from Nintendo thanking me for playing Mario Kart 8 and a few other games and the funny thing is I have not played them online only play it offline I do boot into ofw to update the games don't know if that is why i got the emails or not but iv not played any of the games online or been online with sx os besides checking an addon for breath of the wild like it asked and that took 5 secs and activating the key other then that no i have not and i am still not banned but i do have it set to were they don't get my error logs or anything so i do think that has helped as iv had a few of them that they don't need to see.
so i'm 100% sere they know what i'm doing now so how long do you think i have before they beat me to death with a hammer?

Edit--------
They emails are asking me to redeem gold coins for the games iv played and I know better then that.
Edit---- photo added from email.

This is why people who claim that updating the games is not detectable by Nintendo when it clearly is. The most likely reason that bans have not been sent is because they want to keep us on our toes. I can assure you that no matter how many people were banned with LayeredFS, there are twice as many people NOT banned. Anyways, if you can provide some proof OP, that would also be greatly appreciated (like the e-mail, kinda hard to claim you don't own MK8).

EDIT: There's also the possibility that the data is not shared equally, which would be really weird because the marketing team knows what you do better than the banning team.

That's some good news! As of right now I don't think there is a way to tell how long it'll be until you get banned, but keep playing it safe and do keep is posted.

You should post a screenshot of that e-mail. Nintendo may be looking at a play history log?

If said log doesn't include any information about any "cartridge certs," you may have nothing to worry about. We really don't know enough information one way or the other.

that's good news. after having been banned by sony with the ps3 and having that same banned account on multiple other systems, I've been hesitant to play any backups on my switch. well, the main reason is that I don't want to get up to swap cartridges. I always feel like I'm going to drop the thing. ;)

I mean, i think its pretty obvious Ninti knows that we are updating our games, because you know, we are downloading updates for that games. Thing is, do they know that those games we are updating are not legit?

I cant know that for sure, but it kinda looks like they dont. Ninti has been pretty quick giving bans, but with the evidence we have it seems that just updating games (preferably on OFW) is not a ban. So yeah, i really wonder if they can know if our games have no headers and stuff like that if we are not using online functions on them, just updating (which can be done on any game even with the card out).

I don't see why not. It has to do with an exploit. Where do you feel this should have been posted?

For me, it feels like a personal experience, not so related to exploits. I mean, everything related to SX OS and Atmosphere has to do with an exploit, but that doesnt mean i can post every little thing that happens to me about it. Still, i have no problem with this thread.
