Nintendo tracks down and sues pirate by using Reddit posts and repair orders

Nintendo tracked down an alleged Switch pirate using a combination of Reddit posts and repair orders, a new lawsuit has revealed.

As reported by Game File, Nintendo sued James “Archbox” Williams, from Surprise, Arizona, for allegedly violating its digital copyrights by selling pirated copies of Switch games.

According to the lawsuit, Nintendo hired a law firm called Mitchell Silberberg & Knupp to investigate online pirate video game stores and found a user called Archbox it traced to Arizona. It then spotted a Reddit user called Archbox (Archbox was a moderator of r/SwitchPirates). Based on their posts, the law firm was able to identify Archbox as James Williams. Williams, it turns out, had various Nintendo accounts associated with email addresses, which were tied to repair orders.

Yes, Williams, an alleged Switch pirate, actually made two repair orders with Nintendo tied to a Surprise, Arizona shipping address.

As you’d expect, cease-and-desists followed — one of which came just two days after Nintendo sent him one of his repaired items. The pirate shops Archbox was allegedly involved with include Jack-in-the-Shop, Turtle in the Shop, and NekoDrive, which all shut down following a cease-and-desist Nintendo sent in March.

“Defendant became a leading (if not the primary) moderator of the SwitchPirates Reddit community, which he helped grow to nearly 190,000 members," Nintendo’s initial complaint reads, as reported by Torrent Freak. "Since 2019, Defendant has posted thousands of comments and messages to the SwitchPirates Reddit Group.

“Defendant’s posts have included, by way of example, messages directing users to the Pirate Shops […]; and offering technical advice and encouragement to other users about how to use the Pirate Shops, how to download and install Circumvention Software, and how to play pirated copies of Nintendo Switch games.”

Nintendo now has a default judgment in their favor after Williams failed to plead his case to the court in time.

It's a weird ego to have when you feel like you're safely able to sell hardware with pirated software or services that bundle with pirated software. A lot more shutdowns, C & D's, and lawsuits happening because people are getting too comfortable. Well, that and mainstream media covering Nintendo piracy like it won't have an impact.

Here’s the thing, it’s not illegal to talk about crimes. Anyone can say, “I’m a pirate!” But without evidence, there’s nothing there. Considering this dude flew too close to the sun, it was more than just what he was saying that got him into trouble

Piracy isn’t a crime if you own the originals. If I was to pirate online which I don’t Nintendo couldn’t touch me because I’d host it somewhere where they can’t submit a copyright claim as piracy is legal in certain host countries
I might do it just to stick it to them

Piracy isn't a crime if you make backups of your original games, but pirating online that is from another source is still illegal.
Tbf some things that are illegal are very silly

Consider how many plants are illegal all over the world - and the amount of people who have been imprisoned for possession of plants

They don't track down casual pirate jimmy.

They track down the people that promote piracy in a big way or who run download sites.
The discords of those freeshops the guy was admin of had thousands of members.

Btw. did they also bust this other guy running all the shops, teknik?

people are just getting more and more desperate for money... is why people pirate.... everyone over charging shit.... this is why i'm just not caring anymore... about video games has much. i would like to buy a switch again (give nintendo one more chance but for first party only) but 2023 releases put a sour taste in my mouth also nintendo's garbage online service i would say more but... i don't feel like typing anymore about this...

If you mean overcharging game prices, well prices has not changed for more than a decade. Games could have been $100 if adjusted to inflation.
