Same thing here, I had Wifi, spotpass AND show currently played title with friends and I didn't get banned. I didn't play Sun/Moon/Fire Emblem early on my 3DS tho.I left my Wi-Fi on and didn't get banned. :/ Stupid decision, maybe, but it worked out for me in the end.
Not only they played online, some people put hacked shinies on the GTS before the game's release. I remember that someone took a screenshot of a shiny Litten that some spanish dude put up for trade there just a few days after the leak. Rip that guy and the other one who went to check itmaybe it's a good thing, it weeds out the noobs so they can't play online anymore and makes them learn
alright, there just straight dumbasses if they try to play the game online before release, hell I turned off internet to play superstar saga and samus returns when they leaked even though they have no online play, just be safe if your gona live on the edge
Afaik if you disable Spotpass, stay COMPLETELY offline (Wi-Fi disabled), remove the game's data from the Journal app & delete ALL data created by the game on the day of release (both savegames and other SD/streetpass data) you should be safe. You should also be able to hide the fact that you've played the game early by modding the start date from your savegame but you'd still have to delete everything else and hey, better safe than sorry!But even if you do that, Nintendo will know that you started playing before the game was even out the moment you connect online and possibly try to link your account to PGL (if you do) since trainer card data is sent when connecting online for the first time and every time you sync with PGL. Why not just wait for the game to come out, THEN play?
Lurantis wasn't a reviewer, he most probably was an owner or clerk at a mom 'n pop game shop in russia (the leaked copy was russian) or obtained a ROM from PKHeX's team or somebody else who got it early too (the first screenshot he posted showed no manual for a physical 3DS cartidge in the home menu, which indicates that he used a flashcart as all retail games are supposed to have have a digital manual)Doubt it. When a leak happens while review copies are in the wild the same reviewers aren't given review copies again for obvious reasons.
