I recently got my hands on a new old 3ds xl and it came with 9.4. It is European so Idk about us or Japan. Just saying that not all old 3dss are safe so be careful.

It was updated then returned, the highest firmware a new in box Old 3DS can have is 8.1 and that was the NES limited edition unit.

I think it's likely it was returned but not 100% certain. Your example of a limited edition is poor because they are usually 'one offs' whose firmware is 'frozen in time' unlike ongoing model versions like Blue and Red XL.

OP, what color/edition was your XL?

kinda off-topic but I think it would be a good idea to have a 'latest new old 3ds firmware' thread or something similar like this

OP, what color/edition was your XL?
The Old 3DS stopped production after the release of the NES unit that's how I can say that for certain.

You can't be for certain that it stopped production. Do signs point to it? Maybe, but that's not proof.
There was an interview somewhere where Reggie hinted that production of the 2ds would continue.

Yeah production updates for the o3DS are pretty much done. Nintendo has migrated over to the n3DS. Heck the days of the 2DS may be numbered if they decide to come out with a n2DS. :P

The only risk of getting a o3DS on higher firmware is if you buy a used unit. There's also the small chance the one you buy from a retail store was refurbished/returned and had it's firmware updated. Stores like Wal-Mart don't have high stock turnover and you're almost guaranteed to get a o3DS on exploitable firmware.

It's really not hard at all to find pre 9.2 o3DS consoles these days. Only the n3DS's are getting harder to find on an exploitable firmware range.
