I recently got Sm4sh (USA) on my old gen 3ds XL (EUR) I had issues with the eula. I got the DSES app and put it on accepted but for some reason I still can't go online. Can suggestions?

Why not just get a EU version for smash why use USA version, also the online server goes down April 8th

Online server goes down in two weeks so kinda make it pointless, if you really want you can EU region game so it match your 3ds region so it is easier if you want to use the eshop for update.

There's always Pretendo if you have a jailbroken 3DS.

Hold SELECT while powering on your 3DS. This launches the Luma3DS menu.
Turn on "Enable loading external FIRMs and modules" and "Enable game patching".
Restart the 3DS.
Go to Universal Updater.
Search for "Nimbus".
Install the .3dsx version.
Open the Homebrew Launcher. Launch Nimbus.
Select "Pretendo Network". This can take several seconds.

Now you're using Pretendo. Mario Kart 7 works pretty well so far. Here's their progress page:

Damn. I downloaded the cia version

The CIA version will still work, but it takes up one of the 300 slots the Home Screen is limited to having. That's why I suggested the .3dsx version, because you're only going to ever swap back and forth between now and April 8th, 2024.
