System Settings → Internet Settings → Spotpass → Automatic Software Downloads → No
This should stop the ads.

I'm no expert, but i'll try my best. It appears that Nintendo sends said notifications to any 3DS/2DS that's connected to spotpass, however, 'Tendo never actually stopped autosending the notifications. Yep. If you purchased a New 2DS XL right now and set it up, you would receive notifications for games that were 5 years old. I'm not kidding.
