Yes, I just registered, like 15 minutes ago, instantly recieved an email, clicked the link in it which gave me my password, logged in, accepted the NDA and, well, I guess I'm an Indie-developer nowI can now confirm that the announcement for the two programs merging while keeping the looser Wii U Developers Program restrictions just took place yesterday!
(No wonder why I did not find out about it until today!)

Perfectly legal, but keep in mind you've agreed to an NDA (legally binding contract saying you won't share what you have access to), and terms that state you won't reverse engineer any of their tools. What are the chances if I tried to release a game I develop that I test on cfw that they would ask me about why I never ordered a dev system? If anyone plans on using this to develop actual 3ds games for release on the eshop, keep in mind that while registering and getting the tools is free, the dev kit hardware is $2000+, and while you can probably use cfw to test, good luck explaining to Nintendo how you did it without their hardware.
