What are the chances if I tried to release a game I develop that I test on cfw that they would ask me about why I never ordered a dev system? Assuming I follow all of the guidelines they give for games to get on the eshop would they stop me if they don't have records of me ordering any hardware?

The chances? Pretty much guaranteed. Your account is tied to the dev hardware you own, they probably have checks in place before a person even looks at your submission to check if you own atleast some piece of dev hardware.

Nice how many people SIGN up (mostly with their ORIGINAL credentials) to the Nintendo dev account :)
Let's see what happened next!
For me it looks like they are planing something.
But it could be my paranoid level of thinking ;)

You do know Nintendo isn't the first console maker to make indie development more accessible, right? They're actually a little slow on the uptake here.

I like the open minded way.
But nintendo was never a company that was open minded......more like "behind the walls"!
Nice if it change (maybe because we have now A9LH) but i'am not sure about it.

Wouldn't the dev kit be able to sign/encrypt a game? I can't imagine requiring a 4-digit piece of hardware to do it...

But then again, this is Nintendo we're talking about here, so I wouldn't put such an ass-backwards idea past them.

A friend told me Nintendo will make a Game Jam, and it can be the explanation of that "kindness" from Nintendo.
Who knows? Finaly I'll get that Unity for 3DS!

Haven't tried but Nintendo's sdk can probably sign with developer Keys (so the result will work on Panda, Snake, and Partner)
You can choose to only compile to cxi, then use the homebrew makerom to create an unencrypted 3ds/cia that will work on a retail system with cfw!

I can't imagine requiring a 4-digit piece of hardware to do it...?
You need a Partner-Debugger or -Writer to manufacture slot-1 cards, this is completely unrelated to signing keys

As @Swiftloke said, you will need atleast one piece of test hardware, otherwise Nintendo will wonder how exactly you developed/tested your game. The dev portal says you require a SNAKE DevKit (the orange box, $2000+), but some people have said just a Panda unit will work (~$200)

Pretty sure the boxes are overpriced af. No way is a debug box worth 2000+. Right?
