As soon as you make a nnid or login with your nnid you can redownload the game for free, since the Game is tied to your consoles serial, not your NNID
IF the system you openend, had tomadochi on it and you had to do the whole setup stuff,

- Somebody was smart enough to system format without SD in the system

Refurbished is the only reason I can think, but does nintendo sell refurbished without labeling It as refurbished??...if new! And this is the final answer really! The machine is second hand/refurbished/whatever you want to call it, end of story.
they do that in Europe? usa consoles are not wrapped or otherwise sealed with a watermark plastic . . . just a box and i got mine new at a target store (not online)They shouldn't really. Unless they have that see-through wrapping with the Nintendo watermarks on it.

this is impossible, format system will generate new unique id and setup new folder under Nintendo 3DS dir

returned the Amazon 2DS with 9.9 so I went to a retail shop and picked up another, presumably a shop that wouldn't normally sell many consoles.
Unboxed it right away and surprise! 9.9!
Nintendo is updating 2DS's. Nobody is safe now.
Photo with timestamp and purchase proof, check the time, it's impossible I updated on purpose in the middle of a shopping mall.
