Hacking Unboxed new 2DS + tomodachi bundle, was 9.9E

I bought a brand new 2DS off amazon Spain, specifically the tomodachi life bundle.
I unboxed the console and instantly noticed it was a little dirty wich lead me to think it was used prevoisly.
After the initial set-up I acessed settings and to my suprise it was on 9.9.

Could the system have been returned to amazon by another user? In that case they must've formatted it with system settings to it asked me for the initial set-up when I powered it on. But they can't possibly do that without losing the tomodachi game wich is present on my console.

Could they be shipping 9.9 consoles? How is this possible if this bundle was made on october 2014.

not true if its pre-installed you can format the system all you want and the game like system apps will still remain

sounds like someone was taking advantage of the return policy as 3ds/2ds systems don't come wrapped in plastic i would see if the consoles serial number (on back) matches the one on the box ?

You should request a return/exchange, that is not a new Handheld

I formatted the system just to check and tomodachi life disappeared.
Serials are identical, first thing I checked.

If it's unboxed, dirty and they claim it's new, then that was false advertising.

did you really buy it brand new or did you buy one of their warehouse deals (returned products a bit cheaper) that was 'like new'.

Shipping a 9.9 2DS when box says 2014.

That's possibly one of two things:

1. It clearly didn't come with the right box. Return it.
2. It was possibly updated to 9.9 before it was sent. If so, you were cheated on.

Don't worry about it you were trying to help that's what's important.

It was a brand new system from Amazon and it was full price 100€
Theyll give me a refund as soon as it reaches them.
But it's still puzzling. How did this console get updated and reset without losing the tomodachi game? It was the full version too, not the demo.
Are they shipping 9.9 consoles?
How did they make the system that includes the game and is on 9.9 and also asks for a start-up initialization asking for my name aand country.

1) There isn't any wifi for it to self-update.
2) It's not a Wii U.

They shouldn't really. Unless they have that see-through wrapping with the Nintendo watermarks on it.

Impossible, you cant power on without doing the initial configuration. And if they had formatted after I'd have lost the tomodachi game
